These Terms & Conditions apply to services provided by Arbor Bear Tree Specialists and to the use of our website, arborbear.co.uk.
When you accept a quotation or otherwise instruct Arbor Bear Tree Specialists to undertake work, these Terms & Conditions form part of the agreement between you and Arbor Bear Tree Specialists, together with the accepted quotation and any other terms agreed with you in writing.
Please read these Terms & Conditions carefully before accepting a quotation or instructing us to proceed.
Nothing in these Terms & Conditions affects your statutory rights as a consumer.
1. Our Services
Arbor Bear Tree Specialists provides professional arboricultural and tree care services.
Our services may include:

Tree pruning and maintenance

Tree removal and dismantling
-
Crown reduction
-
Crown thinning and lifting
-
Deadwood removal
-
Hedge cutting and maintenance
-
Stump grinding
-
Tree inspections and advice
-
Emergency and storm-damaged tree work
-
Other associated arboricultural services
The exact scope of work will be specified in your quotation or otherwise agreed with you in writing.
2. Quotations
Unless otherwise stated, quotations are provided based on the information and site conditions reasonably visible or made known to us at the time of inspection.
Unless otherwise stated on the quotation, quotations are valid for 30 days from the date of issue.
Our quotation will describe the work we propose to undertake and the agreed price.
If circumstances affecting the proposed work materially change before work begins, we may need to revise the quotation.
If you request additional work outside the original quotation, this may incur an additional charge. Wherever reasonably practicable, we will agree any additional work and associated costs with you before proceeding.
Where previously unknown conditions are discovered after work has commenced, including hidden decay, unsafe structures, concealed obstructions or other circumstances materially affecting the work, we will discuss any necessary changes with you before undertaking additional chargeable work wherever reasonably practicable.
3. Acceptance of a Quotation
A contract is formed when you accept our quotation or otherwise instruct Arbor Bear Tree Specialists to proceed and we confirm your instruction.
The accepted quotation, these Terms & Conditions and any subsequent changes agreed in writing form the agreement between Arbor Bear Tree Specialists and the customer.
Please check the description of the proposed work carefully before accepting your quotation.
4. Tree Preservation Orders & Conservation Areas
Some trees are legally protected by a Tree Preservation Order (TPO) or because they are situated within a Conservation Area. Permission or prior notification to the relevant Local Planning Authority may therefore be required before certain tree works can legally proceed.
Where required in connection with works being undertaken by Arbor Bear Tree Specialists, we can manage the relevant TPO application or Conservation Area notification on behalf of the customer, including liaising with the Local Planning Authority where appropriate.
Any proposed tree work remains subject to approval and to any conditions, restrictions or alternative requirements imposed by the relevant Local Planning Authority.
The timescale for determining an application or notification is outside the control of Arbor Bear Tree Specialists. Where permission is required, proposed work dates may therefore need to remain provisional until the necessary consent has been obtained or the relevant notification period has expired.
If the Local Planning Authority refuses an application, requests amendments or permits a different scope of work from that originally quoted, we will discuss the available options with the customer. Where this materially changes the scope of the work, the original quotation may need to be revised.
The customer must provide any information or authority reasonably required for Arbor Bear Tree Specialists to submit an application or notification on their behalf.
Arbor Bear Tree Specialists will not knowingly undertake unauthorised work to a protected tree.
5. Ownership of Trees & Authority to Instruct Work
By instructing Arbor Bear Tree Specialists, you confirm that you either:

own the tree, hedge or vegetation concerned; or
-
have the necessary authority from the owner to instruct the work.
Where a tree is owned by, situated on or accessed through neighbouring land, you are responsible for obtaining any necessary permission from the relevant landowner unless we have expressly agreed otherwise.
Arbor Bear Tree Specialists cannot accept responsibility for disputes relating to tree ownership, property boundaries or rights of access where information provided to us is inaccurate or incomplete.
6. Wildlife & Protected Species
All work undertaken by Arbor Bear Tree Specialists is subject to applicable wildlife and environmental legislation.
Trees and hedges can provide important habitats for nesting birds, bats and other protected species.
If an active nest, protected species or another ecological constraint is identified before or during work, we may modify, postpone or stop the affected work where continuing could breach applicable legislation.
Where specialist ecological advice or a survey is reasonably required before work can proceed, this may need to be arranged separately and could incur an additional cost.
A delay resulting from necessary wildlife protection measures will not constitute a breach of the agreed work schedule.
7. Access to the Property
The customer must provide reasonable and safe access to the property and working area at the agreed time.
Where appropriate, please ensure that:
-
vehicles are moved from the working area;
-
gates and access routes are unlocked;
-
garden furniture, ornaments and other movable items are removed;
-
pets and livestock are safely secured;
-
children and other persons remain away from the working area; and
-
our team can access any part of the property reasonably required to complete the agreed work.
If adequate access is not available when we arrive, we may need to postpone the work.
Where a failed visit or substantial delay results from access not being provided as agreed, we reserve the right to recover reasonable costs actually incurred as a result.
8. Underground & Hidden Services
You must tell us about any known underground or concealed services that could be affected by the proposed work, particularly where stump grinding or other ground-level work is required.
These may include:

electricity cables;
-
gas pipes;
-
water pipes;
-
drainage;
-
irrigation systems;
-
telecommunications cables;
-
garden lighting;
-
private electrical supplies; and
-
other underground structures or services.
Where the location of an underground or concealed service is not reasonably apparent and has not been disclosed to us, Arbor Bear Tree Specialists will not be responsible for damage that could not reasonably have been anticipated or avoided.
Nothing in this section excludes our responsibility where damage results from our failure to exercise reasonable care and skill.
9. Working Area & Safety
Tree surgery involves specialist machinery, falling timber, branches, woodchip and other potential hazards.
For safety reasons, customers, children, pets and other members of the public must remain outside any designated working or exclusion area while work is taking place.
We may temporarily restrict access to parts of the property where reasonably necessary to carry out the work safely.
Customers must follow reasonable safety instructions given by our team while work is underway.
10. Weather & Unforeseen Circumstances
Tree work can be affected by high winds, storms, heavy rain, extreme temperatures and other conditions that make work unsafe or impractical.
Arbor Bear Tree Specialists reserves the right to postpone or suspend work where we reasonably believe conditions could compromise the safety of our team, the customer, members of the public or surrounding property.
Where this happens, we will endeavour to arrange an alternative date as soon as reasonably practicable.
Work may also be affected by circumstances outside our reasonable control, including emergency call-outs, road closures, equipment failure, utility issues, restrictions imposed by public authorities or unexpected site conditions.
We will keep customers reasonably informed where these circumstances materially affect an agreed work date.
11. Standards of Work
Arbor Bear Tree Specialists will perform its services with reasonable care and skill and in accordance with the work described in the accepted quotation.
Where applicable, tree work will be undertaken using appropriate arboricultural practices and techniques.
Trees are living organisms. Their future health, growth and appearance can be affected by weather, disease, pests, soil conditions, previous management and other environmental factors outside our control.
We therefore cannot guarantee the future health, growth, appearance or survival of a tree following appropriate arboricultural work unless a specific guarantee has been expressly agreed in writing.
12. Timber, Woodchip & Green Waste
Unless otherwise agreed in your quotation, Arbor Bear Tree Specialists will remove waste and arisings generated by our work and leave the working area reasonably tidy.
Where agreed, logs, timber, woodchip or other material can be left at the property.
If you have requested that timber or woodchip is retained, we will leave it in a suitable agreed location where reasonably practicable.
Tree surgery is an outdoor activity and some residual sawdust, leaves, small twigs or other organic material may remain following completion.
13. Stump Grinding
Where stump grinding is included, the quotation will identify the stump or stumps to be treated.
Unless specifically agreed otherwise, stump grinding does not mean the complete removal of the tree's entire underground root system.
Underground services, stones, concrete, metal, foundations or other concealed objects may restrict the depth or extent to which a stump can safely be ground.
You must inform us of known underground services or structures before stump grinding begins.
14. Parking & Vehicle Access
Some tree work requires access for specialist vehicles, machinery and equipment.
Customers should advise us before the work date of any known:
-
parking restrictions;
-
narrow or restricted access;
-
private road restrictions;
-
permits;
-
controlled parking zones; or
-
other access limitations affecting the property.
Where parking suspensions, permits or specialist traffic-management arrangements are required specifically for your work, any associated additional costs will be discussed with you wherever reasonably practicable before they are incurred.
15. Cancellations & Rescheduling
If you need to cancel or rearrange booked work, please give Arbor Bear Tree Specialists as much notice as reasonably possible.
Where a customer cancels at short notice, we reserve the right to recover reasonable costs that we have actually incurred as a direct result of the cancellation, taking account of the circumstances and our ability to mitigate those costs.
Any cancellation charge will be fair and proportionate.
Where Arbor Bear Tree Specialists needs to postpone work because of weather, safety concerns, illness, equipment failure or circumstances outside our reasonable control, we will contact you and arrange an alternative date.
This section does not affect any statutory cancellation rights available to consumers.
16. Consumer Cancellation Rights
If you are a consumer and enter into a contract with Arbor Bear Tree Specialists online, by telephone or away from our business premises, you may have a statutory right to cancel.
Where applicable, you will normally have 14 days from the date the service contract is entered into to cancel without giving a reason.
If you expressly request that we begin work during this cancellation period, you may be required to pay a reasonable amount for services properly supplied up to the point at which you notify us that you wish to cancel.
Where the service has been fully performed during the cancellation period following the appropriate request and acknowledgement from you, your statutory right to cancel may end.
Nothing in these Terms & Conditions restricts your statutory cancellation rights.
17. Emergency Tree Work
Where emergency tree work is required because of storm damage, a fallen or dangerous tree or another immediate safety concern, it may not always be possible to follow the same advance scheduling process as planned work.
Where reasonably practicable, we will explain the work we recommend and the anticipated costs before commencing.
Emergency work will be limited to work reasonably necessary to address the situation or additional work agreed with you.
18. Prices & Payment
The price for your work will be specified in your quotation or otherwise agreed with you before work begins.
Any applicable VAT will be clearly identified where relevant.
Payment must be made in accordance with the payment terms stated on your quotation or invoice.
If an invoice becomes overdue, Arbor Bear Tree Specialists may contact you to request payment and take reasonable steps to recover sums properly owed.
Where our customer is another business, Arbor Bear Tree Specialists reserves any statutory rights available in relation to interest and recovery costs on overdue commercial debts.
We will not impose disproportionate late-payment charges on consumers.
19. Damage & Liability
Arbor Bear Tree Specialists will exercise reasonable care and skill when undertaking work.
Tree surgery inherently involves the controlled movement and processing of trees, branches, timber and machinery. Reasonable precautions will be taken to protect surrounding property.
Customers should tell us before work begins about any particularly vulnerable structures, surfaces, plants, utilities or other property that may not be obvious to our team.
We will not be responsible for loss or damage:
-
that was not reasonably foreseeable;
-
resulting from inaccurate or incomplete information supplied by the customer;
-
resulting from a pre-existing defect, instability or weakness that could not reasonably have been identified beforehand; or
-
to the extent that the loss or damage was not caused by our negligence or breach of our obligations.
Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Nothing in these Terms & Conditions affects your statutory rights as a consumer.
20. Consumer Rights
Where you contract with Arbor Bear Tree Specialists as a consumer, our services will be provided with reasonable care and skill.
Where no time for performance has been agreed, services will be performed within a reasonable time.
Where no price has been agreed in advance, you will only be required to pay a reasonable price.
Nothing in these Terms & Conditions is intended to exclude or restrict rights or remedies available to consumers under applicable UK consumer law.
21. Complaints
We want customers to be satisfied with the service provided by Arbor Bear Tree Specialists.

Where appropriate, we may ask for an opportunity to inspect the work or property before determining the appropriate resolution.
We will investigate complaints fairly and aim to resolve genuine issues within a reasonable timeframe.
This complaints process does not affect your statutory rights.

Where you are acting in the course of a business, the courts of England and Wales will have jurisdiction in relation to disputes arising from these Terms & Conditions unless otherwise agreed in writing.
